DEFINITIONS:

As used herein, the words “we,” “our,” and “Tucker Farms” mean Tucker Farms, Inc, and the words “you” and “your” mean our customers, potential customers, and any other individuals or entities that use this website.

WHOLESALE ORDERS:

We are always interested in wholesale opportunities. If you represent a restaurant, caterer, grocery store, other institution, or broker, please contact us by phone (770-318-4717) or email (info@tuckerfarmsga.com) to discuss your unique needs.

ORDERING DEADLINE:

To ensure delivery, orders must be placed before 8:00 PM on Tuesday the week of desired delivery date. (Example:  for delivery on Friday, April 3, 2020 or Saturday, April 4, 2020, orders must be placed by 2:00 PM on Tuesday, March 31, 2020)

LATE ORDERS:

  • With prior approval – If you wish to place an order after the Tuesday ordering deadline, email info@tuckerfarmsga.com to check availability.  We understand that life sometimes gets chaotic, and we will always do our best to accommodate reasonable late orders.  However, we reserve the right to refuse any request for a late order for any reason.
  • Without prior approval – Orders placed after 8:00 PM on Tuesday will be delivered the NEXT week unless you have received prior approval as set forth above.

MODIFICATIONS & CANCELLATIONS:

If you need to modify or cancel your order, please send us an email at info@tuckerfarmsga.com and we’ll do our best to accommodate your request.  Many factors affect our ability to modify and cancel orders (especially on short notice), so please be aware that you do not have a “right” to modify or cancel your order.  We expressly reserve the right to refuse to modify or cancel any order for any reason. 

REFUNDS:

Our business depends on maintaining happy and satisfied customers.  If you are dissatisfied with your purchase for any reason, we will do our best to make it right.  However, except in very special circumstances, we do not issue refunds.  We expressly reserve the right to refuse to issue a refund.

OUR PRODUCTS:

We strive to provide all of our customers with the freshest and most delicious produce possible.  Unless noted otherwise, all of the products sold on this website are products that we grew at Tucker Farms.  We attempt to only use pictures of products that we’ve taken with our own camera at the farm.  It is always our goal that pictures on this website, as well as the product descriptions, accurately describe our products.  However, we aren’t perfect, and each individual vegetable we pick is unique, so we can’t guarantee that the products you purchase will look or taste exactly as depicted on this website.

All of our products are sold and delivered “Ready to Wash” – this means that, even if your vegetables look clean, you should wash them before you eat them or serve them to other people.

In order to maintain the freshness and quality of your vegetable purchase, you should refrigerate it as soon as possible after we deliver it.  (Except tomatoes; those are best left at room temperature).  We cannot guarantee the quality or appearance of vegetables that “sit out” at room temperature for several hours after delivery or that remain in a hot vehicle for any period of time. 

We cannot guarantee that orders left at a public or private drop off location will be properly refrigerated; we recommend that you communicate directly with the individual(s) overseeing your drop off location about this.

If you have any questions about proper washing or storage of your purchase, please ask us.

PRICING:

Our prices may change from week-to-week.  And, if you shop in our on-line store and then see us at a farmers market, you may notice that our prices are different.  Many factors affect our prices including, but not limited to, fluctuations in market prices, a product surplus, a product shortage, and how far we drive to a market.  Also, you may think that our prices have “gone up” when, in fact, a promotion ended.  (We offer frequent promotional pricing, but we cannot afford to discount every product every week).  

In short, we reserve the right to change our prices at any time; however, once you have completed an order, the price you paid will not change.  We attempt to be transparent about our pricing decisions, so, if you notice a price change and want to know the reasoning behind it, just ask. 

INFORMATION ABOUT DELIVERY LOCATIONS:

  • Parking Lot Pick-Ups

Parking Lot Pick-Ups are open to the public.  We will wait at each designated pick-up location for the time period specified on this website or until all orders are picked up, whichever time is earlier.  If you do not pick up your order within the designated time period we will donate your order to a local shelter or community kitchen.

  • Drop Offs

Private Drop Offs are closed to the public.  You may place an order for delivery to a private drop off location only if you are employed by the business or live in the designated HOA or you have received express permission from the business owner/HOA to have your order delivered there.  We will deliver to a designated individual (or a designated location) within each private drop off location.  Distribution and/or pick-up of individual orders will be coordinated internally within each business or HOA.

Public Drop Offs are open to the public.  We will deliver to each location at the time specified on this website.  It will be your responsibility to retrieve your order in a timely and polite fashion.  Please coordinate with business where we dropped-off your order to schedule a convenient time for you to retrieve your order during the business’s regular business hours.  Each business serving as a public drop off is providing a generous service to us and to you – please be mindful of this and show your appreciation regularly.

If you do not pick up your order from a drop off location within a reasonable and timely fashion, the business owner overseeing your delivery location may dispose of your order as he or she deems appropriate.  This policy applies to both public and private drop off locations. 

  • Additions, Modifications, & Discontinuations

Tucker Farms, in its discretion, may discontinue any delivery location at any time.  Tucker Farms will fulfill any orders that are outstanding at the time of any such discontinuance. 

From time-to-time, the days and/or times of deliveries may change.  When practicable, all such changes will be noted on the website the week prior to such change(s).

We will always consider adding a new drop off or parking lot pick-up location to our schedule.  If you believe your business (or neighborhood) would make an excellent delivery location, please contact us.

PRIVACY POLICY:

This privacy section of our Policies has been created in order to demonstrate our firm commitment to protecting our customers’ privacy.

  • Information We Collect

To open an account on our site, or to make a purchase, you must provide us with some information about you (e.g., your name, e-mail address, and mailing address). 

When you visit our website, we collect basic information that does not identify you or any other individual user. We use this information to identify our user demographics and interests and to better understand and serve our users.

  • Cookies

Cookies are small files that store certain information about your activity on our website.  Cookies are stored on your computer’s hard drive. Our cookies do not contain any personally identifying information. We use cookies to let us know that you are a prior customer, so that you don’t have to re-enter information you gave us on your prior visits. Most web browsers automatically accept cookies, but most allow you to instruct your browser to prevent the use of cookies. However, if you disable cookies, you will not be able to use certain features of this website.

  • Our Use and Disclosure of Information

After you create an account with us, or make a purchase from us, we may use your purchase history, contact information, and/or other registration information to send correspondence to you regarding changes in our services or other information we believe will interest you.  If you prefer not to receive such correspondence, you can send us an email with the subject line “no emails” or reply to any email we send you with the subject line “no emails.”

If you send us personal correspondence, such as emails or letters, or if other users or third parties send us correspondence about your activities on our site, we may collect such information. We may use that information and other information that we obtain from your use of our site to resolve disputes, troubleshoot problems, and enforce the Policies listed on this website.

We may share aggregate statistics about our sales, traffic patterns, and related site information with other businesses, but these statistics will include no information that identifies you personally. 

In order to ensure that your delivery and pick-up happens as smoothly as possible, we may share your contact information with the business or individual who hosts your delivery location. We will not share your information for any other purpose except as otherwise set forth herein.

We cannot ensure that all of your private communications or other personally identifiable information will never be disclosed in ways not described in this Privacy Policy. For example, we may be required to disclose information to the government or third parties under certain circumstances.  Despite our best efforts to keep your information secure, third parties may unlawfully intercept or access transmissions, private communications, and/or other information that identifies you personally. We can (and you authorize us to) disclose any information about you to law enforcement or other government officials as we, in our sole discretion, believe necessary or appropriate in connection with an investigation of fraud, intellectual property infringements, or other activity that may be illegal or may expose us to legal liability.

  • Security

This site has security measures in place to protect the loss, misuse and alteration of the information under our control.

All orders submitted through this website are processed by a third party credit card processing company.  All user credit card information is securely communicated using secure socket layer (SSL) software, which is the industry standard and among the best software available for secure commerce transactions.

All user information stored on our server is stored in an encrypted format. By using this website, you accept and acknowledge that, notwithstanding these efforts, perfect security does not exist on the Internet, and you understand that, despite our best efforts, we cannot guarantee the complete security of your information.

We are not responsible for the privacy practices, or the content, of any websites that are “linked” to our website.

  • Changes to Privacy Policy; Consent

We may update this Privacy Policy from time to time. You should check this page periodically for changes. By using our site, you consent to the collection and use of your information by us as described in this Privacy Policy.
